If you write, design, code, compose, film, or photograph, you are creating copyright-protected works every day — usually without filing anything. Here’s how copyright works in India and how to make it work for you.
Copyright is automatic
Under the Copyright Act, 1957, copyright arises automatically the moment an original work is created and fixed in a tangible form. You don’t have to register to own it. Registration is optional — but it provides valuable prima facie evidence of ownership if you ever need to enforce your rights in court.
What copyright covers
- Literary works — books, articles, and notably computer programs and databases.
- Artistic works — paintings, photographs, logos, drawings.
- Musical works and sound recordings.
- Cinematograph films and dramatic works.
Copyright protects the expression, not the underlying idea, facts, or method.
The rights you get
Copyright is a bundle of exclusive rights — to reproduce, publish, adapt, translate, and communicate the work to the public. Others need your permission (a licence) to do these things. Authors also enjoy moral rights — to be attributed and to object to distortion of their work.
How long it lasts
For literary, dramatic, musical and artistic works, protection generally lasts the author’s lifetime plus 60 years. For films, sound recordings, photographs, and anonymous works, the term is typically 60 years from publication.
Registration: worth it for key works
While automatic, registering important works (your software, flagship content, brand artwork) with the Copyright Office creates an official record that strengthens enforcement. It’s inexpensive insurance for assets you may need to defend.
Assignment and licensing
Copyright can be assigned (transferred) or licensed (permitted use on terms) — but assignments must be in writing and signed. For businesses, this matters enormously: ensure freelancers, agencies, and contractors assign copyright in the work you pay for, or you may not own it.
Fair dealing
Limited uses — private study, research, criticism, review, and news reporting — may be permitted as fair dealing without permission. But it’s a narrow, fact-specific exception, not a blanket free pass; credit alone is not permission.
