Does the law protect farmers?
Yes. The PPV&FR Act expressly preserves farmers’ rights to save, use, sow, exchange and share seed of a protected variety, and lets farmers register their own varieties.
What is DUS?
The core test for protectability — the variety must be Distinct, Uniform and Stable (with novelty also required for new varieties).
How long does protection last?
Up to 18 years for trees and vines and 15 years for other crops, within the periods specified by the Act.
Who can apply?
Breeders, their successors or assignees, certain institutions, and farmers (for farmers’ varieties).
